By using Coach Kay, operated by KayAI, LLC, you agree to these terms. If you do not agree, do not use the platform.

1. Acceptance of Terms

By creating an account or accessing Coach Kay, you accept these Terms of Service and our Privacy Policy. These terms constitute a binding agreement between you andKayAI, LLC, Delaware, USA.

2. Description of Service

Coach Kay is an athlete wellness and performance platform that provides self-assessment surveys, AI-powered coaching, and personalized response programs. The platform is intended for use by athletes (ages 13–22+) and their authorized coaches, parents, and administrators.

3. Eligibility & Consent

You must be at least 13 years old to use the platform. Users under 13 require verifiable parental or legal guardian consent before we collect any personal data. Users ages 13–17 must have parental or legal guardian consent. Organizations are responsible for obtaining and managing consent for their athletes and must maintain records of consent.

By registering a user under 18, the organization or parent confirms they have obtained appropriate consent and that the athlete's participation complies with applicable law, including COPPA (for users under 13) and applicable state and national privacy laws.

4. Children's Privacy (COPPA)

We comply with the Children's Online Privacy Protection Act (COPPA) for users under 13. Specifically:

• We do not knowingly collect personal information from children under 13 without verified parental consent.
• Organizations must obtain and maintain parental consent before enrolling athletes under 13.
• Parents may contact us at privacy@coachkayteam.com to review, correct, or delete their child's data.
• We do not condition participation on disclosure of more information than is reasonably necessary.
• We do not use data from users under 13 for advertising or commercial profiling.

5. Acceptable Use

• Use the platform only for its intended purpose.
• Do not share account credentials.
• Do not attempt to access data belonging to other organizations.
• Do not misuse AI coaching features or submit harmful content.
• Do not reverse-engineer, scrape, or disrupt the platform.
• Do not submit false or misleading information during onboarding or check-ins.

6. Intellectual Property

All content, scoring algorithms, branding, and technology provided throughCoach Kay are the property of KayAI, LLC. You may not reproduce, distribute, or create derivative works without written permission.

7. Data & Privacy

Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. The data controller for personal data collected through Coach Kay is KayAI LLC.

Athletes have the right to access, correct, delete, and export their personal data. See our Privacy Policy for instructions on exercising these rights.

8. Disclaimer & Limitations

Coach Kay and all content, including AI-generated coaching feedback, are provided for informational and educational purposes only. They do not constitute medical, psychological, or clinical advice. Always consult qualified professionals for health concerns. KayAI, LLC is not liable for damages arising from use of the platform to the fullest extent permitted by law.

In jurisdictions where liability cannot be fully excluded (including the EU and UK), our liability is limited to the maximum extent permitted by applicable law.

9. Termination

We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your right to use the platform ceases immediately. Athletes may request a data export before termination.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Delaware, USA. For users in the EEA, applicable EU consumer protection and privacy laws apply and take precedence where they conflict with these terms. Disputes will be resolved through binding arbitration except where prohibited by applicable law.

11. Changes to Terms

KayAI, LLC reserves the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the platform after the effective date of changes constitutes acceptance of updated terms. For users under 18, renewed parental consent may be required for material changes.
